Key Responsibilities

Conduct comprehensive, person-centred Best Interest Assessments in line with the Mental Capacity Act (MCA) 2005 and Deprivation of Liberty Safeguards (DoLS) framework.

Safeguard the rights of individuals under assessment by ensuring clear, accessible communication regarding legal processes.

Compile high-quality, legally compliant reports, suitable for courts, legal panels, and internal review.

Manage assessments within statutory deadlines, ensuring robust evidence-based decision-making.

Involve service users, families, and professionals in the assessment process, capturing their views and representing their interests.

Identify and escalate objections to the Court of Protection, ensuring individuals’ rights are protected.

Mediate between service users and carers where necessary, promoting resolution and access to support.

Recommend Relevant Persons Representatives (RPRs) and ensure all legal safeguards are in place.

Deliver training and workshops on DoLS and mental capacity to internal staff and external stakeholders.

Provide mentoring and case consultation to social care professionals, enhancing their understanding and practice in MCA-related issues.

Liaise across agencies and departments to raise awareness of DoLS responsibilities and to promote lawful, ethical practice.

Participate in a BIA duty rota, responding to urgent assessments in a timely manner.
Essential Criteria

Professional qualification in Social Work, Nursing, Occupational Therapy, or Psychology.

Completion and ongoing maintenance of Best Interest Assessor (BIA) certification.

Substantial experience conducting DoLS assessments and complex Mental Capacity Assessments.

Sound understanding of current legislation, including the MCA, DoLS, and Human Rights Act.

Proven ability to operate independently within multi-disciplinary frameworks.

Excellent analytical, documentation, and communication skills.
